A creator who licenses digital artwork, an AI-assisted video or a permitted digital-human asset may expect a royalty whenever the work changes hands. Token standards can help different marketplaces understand royalty preferences, but compatibility does not make every payment legally or technically enforceable. ERC-2981 is a valuable example because it standardizes a royalty query without turning every token transfer into a verified sale. This guide separates the signal, the commercial agreement and the settlement ledger, then describes how to test each. It is not legal advice and does not assume that an NFT transfer itself grants rights to train models or reproduce a likeness.
Read what the royalty interface actually returns
ERC-2981, created in September 2020, defines royaltyInfo(tokenId, salePrice), which reports a recipient and royalty amount for a supplied sale price. The standard explicitly treats payment as voluntary because a transfer can represent a gift, custody change or other non-sale event. This is more limited than a creator contract that promises an enforceable percentage of net resale proceeds. Implementers should display the royalty recipient, currency denomination and calculation basis before asking buyers to sign. For an AI creator marketplace, tie the token metadata to a separate license and do not imply that possession grants unrestricted voice cloning, portrait reuse or advertising rights. A user should be able to distinguish ownership of a token from permission to exploit associated media.
Separate token movement from economic settlement
An event showing a token moved between wallets is not reliable proof that money was paid. The parties may transfer a token between their own wallets, swap outside the marketplace or settle a bundle with a different economic allocation. If a platform advertises “automatic creator royalties,” specify where payment enforcement occurs. A marketplace can voluntarily execute the royalty payment within its sales contract and emit a receipt; a bare peer-to-peer transfer does not have to do so. In the revenue ledger, preserve gross sale amount, currency, royalties due, marketplace fees, taxes when applicable, refunds and net creator entitlement. Never infer creator earnings solely from ERC-721 Transfer events. A genuine royalty report must reconcile observed payments to the platform’s settlement terms.
Connect ERC-721 ownership to an explicit license
ERC-721 defines a non-fungible token interface; it does not by itself decide copyright, personality rights or the scope of AI training permission. A creator digital-human asset might include a photo, voice performance, motion sample and written persona. These can have distinct owners or territorial restrictions. Draft an asset license registry that records the particular protected material, rights granted, purpose, territory, duration, sublicensing authority and termination procedure. Refer to the current license version from the product interface. The contract should make clear which rights survive a sale and which require renewed approval. This prevents token holders from assuming that purchasing a collectible authorizes commercially deploying another person’s face or voice in every context.
Handle refunds and partial sales without invented certainty
Suppose a buyer purchases a bundle containing several media assets and later refunds one component. A platform should not apply the full bundle price to each token’s royaltyInfo query and double count the total. Define the allocation methodology contractually before sale, then calculate royalties against the actually recognized eligible price. If a refund arrives after payout, an accounting reversal or reserve may be necessary; ERC-2981 does not prescribe that process. Track settlement version, refund window and finalization status separately from blockchain finality. A payment might be irreversible on-chain while a consumer claim remains open off-chain. That mismatch is why treasury reserves, claims handling and clear terms are operational controls, not incidental details of a smart contract.
Check how dynamic metadata affects buyer expectations
Some token collections can change metadata or linked media after minting. In AI creator markets, assets may also receive updated generation models, new voices or new licenses. Decide whether the token represents a fixed edition or a changing service entitlement. Record content hashes and a visible version history for important updates, without publishing private source files. Where a creator withdraws permission for future output, distinguish stopping new generation from retroactively altering lawful copies already delivered. A royalty recipient change also deserves a documented approval path, especially when collaborative creators or agencies share revenue. Make sure users know whether a royalty percentage refers to the current contract state or a promise made at original sale.
Test marketplace cooperation and adversarial routes
Create a small test suite with an ordinary sale, a transfer without consideration, a zero-price sale, a discounted sale, a bundled sale and a refund. Compare platform-calculated royalty to the ERC-2981 response, then inspect whether the marketplace actually paid the recipient. Verify the unit of exchange: the royalty amount returned must be denominated in the salePrice unit, not silently converted to some unrelated currency. Include a marketplace that ignores the signal to demonstrate the standard’s enforcement limitation. Review unexpected royalty recipients and contract upgrades. For consumer transparency, the interface should distinguish “royalty information available,” “royalty included in this transaction” and “royalty actually settled.” These statements represent different facts.
A practical integration contract for AI media creators
An implementation agreement should define the media rights separately from royalty plumbing, name each entitled party, identify the payment channel and set out refunds and disputes. The product must disclose whether royalties are on-chain, off-chain or a mixture, and whether resale activity outside the supported venue is observable. Build reports around actual receipt identifiers and settlement amounts, not assumed resale volume. Audit the ERC-2981 interface and access controls, then test the surrounding business logic. When the public promise is carefully bounded, royalty metadata can improve interoperability and reporting. When it is marketed as automatic universal enforcement, it encourages creators to rely on a guarantee the standard was never designed to supply.
